Welcome to First Bauble Co.
These Terms of Service (“Terms”) govern your use of our website and the purchase of products from First Bauble Co.
Throughout these Terms, the terms “we”, “us” and “our” refer to First Bauble Co.
Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.
By visiting our website, using our services or purchasing a product from us, you agree to these Terms, together with any policies referenced on our website.
Please read these Terms carefully before using our website or placing an order.
Nothing in these Terms is intended to exclude or restrict any rights you have under applicable UK consumer law.
SECTION 1 – USING OUR WEBSITE
You may use our website only for lawful purposes.
When placing an order, you must provide information that is accurate, current and complete, including your contact, billing and delivery information.
You are responsible for ensuring that the information you provide is correct.
You must not misuse our website, interfere with its operation, attempt to gain unauthorised access to it, introduce malicious software, or use it for fraudulent or unlawful purposes.
We reserve the right to restrict or terminate access to our website where we reasonably believe these Terms have been breached.
SECTION 2 – OUR PRODUCTS
First Bauble Co sells personalised products that are made to order according to the personalisation details selected or submitted by the customer.
We make reasonable efforts to display and describe our products accurately.
However, colours and appearance may vary slightly depending on your device, screen settings, lighting and the nature of the production process.
Minor differences that are inherent in the production process may occur.
This does not affect your statutory rights where goods are faulty, damaged, not as described or otherwise do not conform to the contract.
We may update product descriptions, designs, options or availability from time to time.
We may also discontinue products or limit quantities where reasonably necessary.
SECTION 3 – PERSONALISATION
Customers are responsible for carefully checking all personalisation information before placing an order.
This includes, where applicable:
• names;
• years;
• text colours;
• name styles;
• decoration choices; and
• any other personalised information submitted with the order.
We will normally produce your product using the information you submit.
If you discover an error after placing your order, please contact us as soon as possible.
If production has not yet started, we will try to accommodate your requested change. However, we cannot guarantee that changes or cancellations will be possible once an order has entered production.
Where a product has been correctly produced according to the personalisation information submitted by the customer, we will not normally provide a replacement or refund solely because the customer submitted incorrect personalisation.
This does not affect your statutory rights where the product itself is faulty, damaged, not as described or has not been produced according to the personalisation information you submitted.
SECTION 4 – ORDERS
When you submit an order, you are offering to purchase the products in that order.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
• a product is unavailable;
• payment cannot be authorised;
• there is an obvious pricing or product information error;
• we suspect fraudulent activity;
• we cannot fulfil the personalisation requested; or
• we are unable to deliver to the address provided.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order.
You will receive an order confirmation using the contact information provided at checkout.
Please check your order and personalisation details carefully.
SECTION 5 – PRICES AND PAYMENT
All prices are displayed in the currency shown on our website.
The price you pay will be the price displayed at checkout when your order is submitted, subject to the correction of obvious pricing errors where permitted by law.
Discounts, promotional offers and bundle pricing may change or end at any time unless otherwise stated.
Where a promotion has additional terms, those promotional terms will also apply.
Free UK delivery is offered where stated on our website.
Any additional charges that apply to an order will be displayed before you complete checkout.
Payment must be successfully authorised before we process an order.
Payments are processed using the payment methods available through our checkout.
SECTION 6 – PRODUCTION
Our personalised products are made to order.
Please allow up to 120 hours (5 days) for production unless a different production time is clearly stated on the relevant product page.
Production times are estimates and may occasionally be affected by circumstances outside our reasonable control, particularly during busy seasonal periods.
Once production has begun, changes to personalisation or cancellation may no longer be possible.
SECTION 7 – SHIPPING AND DELIVERY
Once production is complete, UK delivery typically takes a further 2–3 days.
We therefore recommend allowing up to approximately 7–8 days in total between placing an order and receiving it.
Delivery times are estimates rather than guaranteed delivery dates unless we expressly state otherwise.
During busy periods, including the Christmas season, production or delivery may take longer.
Any Christmas ordering dates displayed on our website are intended to help customers order in sufficient time but do not constitute a guaranteed delivery date unless expressly stated otherwise.
We are responsible for the goods while they are in transit as required by applicable UK consumer law.
Goods normally remain at our risk until they come into the physical possession of you or a person identified by you to receive them, subject to any applicable legal exceptions.
Customers are responsible for providing a complete and accurate delivery address.
If you notice an address error after ordering, please contact us immediately. We will try to correct it before dispatch where possible, but we cannot guarantee that changes can be made once fulfilment has begun.

SECTION 8 – RETURNS, REFUNDS AND PERSONALISED GOODS
Our products are personalised and made to the customer's specifications.
As a result, personalised products are generally excluded from the standard change-of-mind cancellation right that applies to many distance purchases.
We therefore do not normally accept returns or cancellations simply because you have changed your mind where a product has been made to your specifications or is clearly personalised.
This does not affect your statutory rights.
If your product is faulty, damaged, not as described, or does not match the personalisation details you submitted, please contact us as soon as possible.
Where applicable, we will provide an appropriate remedy in accordance with your legal rights.

SECTION 9 – DAMAGED OR INCORRECT ORDERS
If your order arrives damaged, faulty or incorrect, please contact us as soon as reasonably possible.
Please provide:
• your order number;
• a description of the problem; and
• photographs of the product and packaging where appropriate.
We will review the issue and, where applicable, arrange an appropriate remedy, which may include a replacement or refund.
Nothing in this section limits your statutory rights.
SECTION 10 – PRODUCT AVAILABILITY
Products and personalisation options are subject to availability.
We may change or discontinue products, designs or personalisation options at any time.
If we are unable to fulfil an order after payment has been taken, we will contact you and provide an appropriate refund for the affected product or order.
SECTION 11 – INTELLECTUAL PROPERTY
Unless otherwise stated, the content of our website, including our branding, logos, product photography, graphics, text, designs and other original material, belongs to First Bauble Co or is used by us with permission.
Such material may be protected by applicable intellectual property laws.
You may use our website for personal and non-commercial purposes.
You must not reproduce, distribute, sell, commercially exploit or materially modify our protected content without our permission, except where permitted by law.
The Shopify name and associated trademarks belong to Shopify and/or its affiliates.
Other trademarks appearing on our website belong to their respective owners.

SECTION 13 – RELATIONSHIP WITH SHOPIFY
First Bauble Co is powered by Shopify, which enables us to provide our online store and related services.
However, products purchased from our store are purchased from First Bauble Co and not from Shopify.
First Bauble Co is responsible for the sale of products through our store, subject to these Terms and applicable law.
SECTION 14 – PRIVACY
We process personal information in accordance with our Privacy Policy.
Information you provide when using our website or placing an order may be processed by Shopify and other service providers where necessary to operate our store, process payments, fulfil orders, provide customer service and perform other legitimate business functions.
